The Department of Justice sent out a tweet before releasing more than 30,000 new documents from the Epstein files, saying some of the documents contain “untrue and sensationalist claims made against President Trump.” The documents in fact, do contain damning documents from an apparent suicide note from Epstein to Nassar along with flight logs that show Trump on Epstein’s private plane more times than previously known, apparently with alleged Epstein victims. While the President is NOT accused of doing anything criminal, it is certainly raising a number of questions. As the judge imposed the maximum sentence for Brian Walshe, she took the opportunity to let her feelings be known, saying her sentence was appropriate given his  murderous acts and the life trauma he’s caused his children. The state of Georgia has just suspended the execution of 52-year-old Stacey Humphreys scheduled for this Wednesday. Because two members of its pardons and parole board have alleged conflicts of interest, the clemency hearing scheduled for today has now been “postponed until further notice.”  Humphreys had already made headlines earlier for his exorbitant and jaw dropping last meal request which you have to hear to believe. Finally, as Florida continues its record setting year of executions, its last lethal injection is set for Thursday, just as new research shows public opposition for the death penalty is at its highest level in nearly 50 years. See omnystudio.com/listener for privacy information.

Criminal Defense Attorney Alison Triessl joins Amy and T.J. to discuss today’s sooner than expected guilty verdict in the Brian Walshe trial. Triessl talks about how the defense overplayed its hand, and already had an uphill battle with those devastating and gruesome searches Brian made shortly after his wife Ana’s death. Despite the prosecution’s lackluster presentation, and the lack of a body or known cause of death, it took the jury less than 6 hours to return a guilty verdict.   See omnystudio.com/listener for privacy information.

The prosecution spent a little more than half an hour trying to convince the jury to use their common sense and convict Brian Walshe of First Degree murder for what they call the “violent death” of his wife Ana on New Year’s Day three years ago. The defense attorney for Brian Walshe, Larry Tipton,  spent this morning making his best case for why jurors should find Brian Walshe not guilty of first degree murder in the death of his wife Ana. A somewhat shocking day in the Brian Walshe trial with the defense announcing not only will Brian Walshe not testify, no one else will either. It’s a decision based on strategic confidence or avoidance of risk, but either way, the defense surprised a number of legal experts who were anticipating at least a few witnesses to take the stand in defense of Walshe. Today’s decision suggests Walshe’s defense team feels good about their ability to sew reasonable doubt in the minds of jurors through their cross examination of the state’s witnesses. Closing arguments are set for tomorrow!See omnystudio.com/listener for privacy information.
It was the prosecution’s final day of testimony and they saved the best for last. The day began with Gem Mutlu, one of the Walshe’s dear friends and most notably, the man who spent New Year’s Eve with the couple in the hours leading up to Ana’s death. The prosecution struggled with Mutlu’s testimony, and it’s unclear whether it did more harm than good. The final witness for the state was one of Ana’s best friends who had some incredible details we have yet to hear about the Walshe’s marriage, but once again, she seems to have both helped and hurt the case against Walshe. See omnystudio.com/listener for privacy information.

It was a complicated, technical day of blood evidence highly important to the prosecution’s case, but the problem was, it was difficult for anyone other than a forensic scientist to absorb and understand the testimony. Walshe’s attorneys were able to keep things simple on cross examination though, getting the state’s witnesses to admit two very important things to the jury. First, that there was no blood found in the Walshe’s bedroom or bathrooms, and second, while there was blood found on the basement floor, no crime lab test could reveal how or when that blood got there. See omnystudio.com/listener for privacy information.

Week 2 of the Brian Walshe trial is underway, but on Friday jurors heard texts Walshe sent to his missing wife’s phone well after he knew she was already dead. The prosecution revealed a series of texts in the hours and days following Ana Walshe’s death, feigning concern about her and expressing his love for her. However, the defense made some impressive progress during cross examination, chipping away at premeditation, showing other texts and searches that reveal a loving husband who seemed unaware his wife was having an affair.See omnystudio.com/listener for privacy information.

It’s day one of the Brian Walshe murder trial and it’s already off to a dramatic start. In their opening arguments, prosecutors read aloud Walshe’s Google search titles the night his wife Ana went missing, and boy are they damning.  The defense began by admitting to jurors that their client has lied to authorities, and yes, he dismembered and disposed of his wife body, but they maintained he did not kill her, he just panicked after finding her inexplicably dead. Prosecutors say Indiana’s Stand Your Ground Law does not apply to homeowner Curt Anderson, who fired a single shot from the top of his stairs, through his front door, killing a 32-year-old house cleaner who’s GPS sent her to the wrong home. Anderson said he feared for his life when he was awakened to the sound of someone trying to enter his home, grabbed his gun and fired. He maintains it was his right to do so under the stand your ground law, but prosecutors maintain that fear alone is not enough to justify invoking the law. This is just the latest tragedy to unfold where a gun owner kills someone who actually meant them no harm, and is reigniting the debate on whether these laws embolden people to shoot first, and ask questions later.See omnystudio.com/listener for privacy information.
It’s a headline three decades in the making. The executor of the O.J. Simpson estate has publicly acknowledged it owes $58 million dollars to the family of Ron Goldman, but the most the family might ever see would be between $500,000 and $1,000,000, and even that might be a long shot. The Goldman’s have to essentially “get in line” with other creditors, including the IRS, following the death of Simpson last year. This all stems from the civil case where Simpson was found liable for the deaths of Ron Goldman and Nicole Brown Simpson, the jury awarding the families $33.5 million dollars at the time. Right now, Simpson’s estate is auctioning off Simpson’s remaining memorabilia to try and raise enough cash to pay down its debts, but turned down a very high profile offer from Kim Kardashian, who was looking to purchase a very sentimental item for her family.See omnystudio.com/listener for privacy information.

In them, Epstein not only writes that President Trump “knew about the girls," but also muses why Trump hasn’t “barked” yet. Epstein also conspires with Wolff in an email just before a presidential debate in 2015 about how to leverage what Trump knows, to secure “valuable PR and political currency. The White House has responded, but these emails will require a lot more explanation than a brief statement from Karoline Leavitt. See omnystudio.com/listener for privacy information.
No matter where you stand on the death penalty, this is a powerful and personal conversation with a mother who has already lost one son and is about to lose another after they were both convicted of the 2002 robbery and murder of Ronnie Wipf. It’s a tale of two brothers, an imperfect system and the families devastated by a New Year’s Day murder. Linda Wood’s older son, Jake admitted to the actual murder and received life in prison, her younger son Tremane was convicted of the same crime, but received the death penalty. After the Oklahoma pardons and parole board recommended clemency for Tremane last week, Amy and T.J. recorded an entire episode about the case. Now, as his family waits to see if the Governor will follow the board’s recommendation, his mother and two nieces talk about the torturous past few months and the excruciating hours to come, waiting to find out if the man they describe as the glue of their family will be executed on Thursday.See omnystudio.com/listener for privacy information.
The Vail School District in Arizona has been forced to add extra security to protect teachers and students at Cienega High School after they posted a picture to their Facebook page showing a math teachers’ group Halloween costume. It was meant as a math joke, t-shirts that looked like they had blood stains on them with the words “Problem Solved” on the front, but it was interpreted by Charlie Kirk’s own organization, Turning Point USA, as mocking their late founder’s assassination. Even after the district posted an explanation and photographic proof that the teachers had worn the same costume the year before, some conservative activists and prominent national leaders doubled down, posting the teachers’ names, phone numbers and demanding they be fired. The school has had more than 3-thousand hateful messages, including death threats, with the school superintendent asking for better understanding.See omnystudio.com/listener for privacy information.

The House Judiciary committee sent a letter to President Trump today demanding answers about special treatment of Ghislaine Maxwell after receiving what they call “whistleblower” information about Maxwell’s time at FPC Bryant, aka “Club Fed.” The letter accuses Trump of a quid pro quo agreement with Maxwell and urges the president not grant any form of clemency to “an unrepentant sex offender.”See omnystudio.com/listener for privacy information.

Apparently Ghislaine Maxwell is enjoying her time in her new digs… according to a series of emails she’s sent to her family and attorneys. The House Judiciary committee obtained private emails from Maxwell during her first few months at her new, lower security prison camp that were also released, in part by NBC News. In them, she discusses everything from how kind and helpful the warden has been to the better food to her reaction to the Sean “Diddy” Combs trial and verdict. There are calls for the warden to respond to accusations of special, VIP treatment for Maxwell and even an ask by members of congress to visit the facility and interview other inmates about what is really happening inside the prison camp walls. See omnystudio.com/listener for privacy information.

Today the Oklahoma Pardon and Parole Board recommended clemency be granted to 46-year-old Tremane Wood. Wood was convicted of stabbing and killing Ronnie Wipf during a 2002 New Year’s Day robbery. Wood has maintained his innocence for the past 2 decades, and his lawyers today presented a compelling enough argument that gave him a 3-2 decision in favor of clemency. Now Oklahoma’s Governor must decide whether to  uphold the recommendation or keep Wood’s execution date set for next week on November 13th.See omnystudio.com/listener for privacy information.

The state of Texas is set to execute 58-year-old Robert Roberson next week, but his attorneys have filed a last minute request for a new trial based on a recent Dateline podcast. Roberson would be the first person to ever be put to death for shaken baby syndrome, following the 2002 death of his 2 year old daughter Nikki. The science he was convicted on is no longer regarded and is considered “junk science.”  That information alone brought lawmakers from both sides of the aisle to intervene last year, to stay his execution, but that stay is up and Roberson time is up.
