On this episode, Dan and Pat are joined by David Shapiro again (previously on Episode 5) to discuss the recent victory for the appellant in Beaman v. Freesmeyer before the Illinois Supreme Court. After being wrongfully convicted and incarcerated for 13 years, in 2008, Beaman's conviction was overturned and he was subsequently pardoned on the basis of being innocent. He is now pursuing state law claims against the officers who he claims maliciously prosecuted him after having his Section 1983 claims dismissed by the 7th Circuit. In Episode 6, we will discuss two oral arguments before the Supreme Court of the United States, Uzuegbunam v. Preczewski and AMG Capital Management, LLC v. FTC, and one before the Seventh Circuit, Platinum Supplemental Insurance v. Guarantee Trust Life Insurance. Uzuegbunam deals with our old friend standing and whether nominal damages are sufficient to support Article III standing for a constitutional violation. AMG Capital Management, LLC is an important case for the textual means of statutory interpretation and deals with whether the Federal Trade Commission can seek restitution in federal court. Platinum Supplemental concerns means of contract interpretation and what sources can be used to interpret a term that is unambiguous.
